Bumo Terms of Use
Effective Date: April 25, 2025
Welcome to Bumo, an online marketplace operated by Parc Ventures Inc. (“Bumo,” “we,” “us,” or “our”). These Terms of Use (“Terms” or “Agreement”) govern your access to and use of the Bumo website, mobile applications (including Android and iOS apps), Provider Dashboard, and other offerings or services (collectively, the “Bumo Platform” or “Services”). By accessing or using the Bumo Platform, you acknowledge that you have read, understand, and agree to be bound by these Terms.
Please read them carefully. If you do not agree with any part of these Terms, you must discontinue using the Bumo Platform immediately.
1. Introduction & Key Definitions
- “Families” or “Parents”: Users who search for, book, or otherwise use child care services via the Bumo Platform.
- “Providers”: Users (including licensed or license-exempt child care centers, home-based caregivers, camps, etc.) who publish and offer child care services on the Bumo Platform.
- “Custom Care Plan (CCP)”: A medium- to long-term care package for families, arranged at discounted or special rates beyond standard on-demand bookings.
- “On-Demand Booking”: A short-term or ad-hoc booking of child care service.
- “Platform”: Refers collectively to Bumo’s website, mobile apps, provider dashboard, and any related software, features, tools, or services.
2. Scope of Services
2.1 Marketplace Role
Bumo acts as a marketplace that allows Families to discover, book, and pay for child care services offered by independent Providers. Bumo is not itself a child care provider and does not employ or manage Providers. Each Provider is an independent entity responsible for its own operations, licensing, and compliance with applicable regulations.
2.2 Child information
Because our Services involve minors, we take extra care to address privacy. However, Families are solely responsible for evaluating Providers and ensuring that each Provider meets their specific needs and requirements, including the handling of children’s data and any additional documentation or forms required by law (e.g., immunization records, health forms).
3. Account Registration
3.1 Eligibility
You must be at least 18 years old and have the legal authority to enter into binding contracts to use most features of the Bumo Platform. By using the Bumo Platform, you represent and warrant that you meet these eligibility requirements.
3.2 Accuracy of Information
When creating your account, you agree to provide truthful, accurate, and complete information and to promptly update any changes. You are responsible for all activity under your account, including safeguarding your username and password.
4. Licensing & Regulatory Information
4.1 Licensing Offices & Provider Compliance
Certain Providers on Bumo may hold official government-issued licenses. Bumo may collect, display, or verify basic licensing information (e.g., license numbers, licensing office address, phone). However, Bumo does not guarantee the accuracy, completeness, or currency of any license data. Providers are solely responsible for maintaining valid licenses, meeting regulatory requirements, and keeping their licensing information up to date on the Bumo Platform.
4.2 No Endorsement or Guarantee
Bumo’s display of licensing information or the generation of licensing-related forms does not constitute an endorsement or guarantee of the Provider’s legality, safety, or suitability.
4.3 Licensing Form Automation
Bumo may offer tools to automatically generate PDF forms (e.g., with JotForm integrations) that include the Provider’s name, license number, address, and other details. Families must understand that:
- Accuracy: It is their responsibility to ensure the information supplied (e.g., child’s data, health info) is accurate.
- Consent: Bumo will only generate or reuse child data for licensing forms with parental consent.
- No Liability: Bumo is not liable for errors in these documents or for any regulatory outcomes from incomplete, inaccurate, or rejected forms.
4.4 Required-Forms Service (Form Re-use)
When you (the Family) book a licensed child-care location for the first time, Bumo may ask you to complete state-required forms (e.g., licensing, immunization, physician clearances, emergency contacts). By default, you consent to Bumo securely storing these documents and—when you book a different licensed Provider—automatically updating the forms with the new Provider’s details and transmitting them on your behalf (“Form Re-use”).
- You may withdraw this consent at any time in your account settings or by emailing support@bumo.com before the new booking’s start date.
- You are responsible for reviewing the pre-populated information and updating it if any child, medical, or emergency details have changed.
- Bumo provides Form Re-use for your convenience only and makes no warranty that the automatically updated forms will meet every jurisdiction’s or Provider’s specific requirements; ultimate responsibility for compliance rests with you and the Provider.
- If you revoke consent, you will be prompted to complete new forms manually, and failure to do so may result in booking cancellation under the applicable cancellation policy.
5. Booking & Payments
5.1 Booking Through Bumo
Families can browse Providers, view schedules, and book care sessions directly via the Bumo Platform. Payments are processed securely through our third-party payment partner(s), such as Stripe. By booking, you agree to pay all associated fees, including taxes and any Bumo service charges.
5.2 Provider Rates & Availability
Providers may change their availability and rates at any time. Bumo is not responsible for notifying Families of such changes.
5.3 On-Demand vs. Custom Care Plans (CCP)
- On-Demand: Short-term or a la carte bookings at the posted hourly or session rate.
- CCP: Medium- to long-term child care packages with potential discounts or special payment arrangements. All CCP terms, including cancellations or refunds, may vary from on-demand bookings and will be communicated to the Family prior to purchase.
6. Provider Responsibilities
- Accurate Listings: Providers shall create and maintain accurate listings, including rates, availability, and any licensing or certification details.
- Operations & Safety: Providers are independently responsible for the quality, safety, and legality of their services, including staff qualifications, background checks, and compliance with local laws.
- Licensing & Forms: If Providers upload or modify license numbers, they must be valid 9-digit numbers (where required), and any mismatch or invalid data may result in the listing being paused or removed.
- Provider Dashboard: Providers may have access to a Provider Dashboard to manage bookings, track earnings, and update availability. Providers are responsible for regularly checking this dashboard to stay current on bookings and other updates.
- App Onboarding: For Providers using Bumo’s mobile or web apps to onboard, all requested information (e.g., tuition details, daily schedule, photos, business documents) must be submitted truthfully. Bumo may remove or suspend Providers who provide incomplete or false data.
6.1 Health & Safety Standards
Providers must adhere to high standards of health and safety to ensure the well-being of children under their care. All Providers using the Bumo Platform agree to:
- Maintain a Clean & Hygienic Environment – Child care spaces, toys, and equipment must be regularly cleaned and sanitized to prevent the spread of illness.
- Follow Sick Child Policies – Providers must implement and enforce policies that prevent the attendance of children who are ill or contagious. Parents must be notified promptly if a child exhibits symptoms of illness while in care.
- Ensure Proper Supervision & Child-to-Provider Ratios – Providers must comply with local regulations regarding supervision requirements, ensuring that appropriate staffing levels are maintained at all times.
Bumo reserves the right to suspend, restrict, or remove any Provider who fails to adhere to these standards.
6.2 Professional Conduct
Providers are expected to maintain professional and respectful conduct in all interactions with families and Bumo staff. This includes:
- Clear and Timely Communication – Providers must respond to parent inquiries, booking requests, and Bumo communications in a professional and timely manner.
- Adherence to Agreed-Upon Schedules & Policies – Once a booking is confirmed, Providers are expected to honor the agreed-upon schedule. Cancellations or repeated schedule violations may result in penalties, including temporary suspension.
- Respectful Treatment of Families & Children – Providers must create a welcoming and inclusive environment for all families. Any reports of discrimination, harassment, or inappropriate behavior may result in immediate removal from the platform.
6.3 Scheduling & Availability Updates
Providers are responsible for keeping their availability up to date. Failure to maintain accurate schedules may result in temporary closure of booking slots or removal from the platform. Providers agree to:
- Regularly Update Availability – Any changes to availability, operating hours, or closures must be promptly reflected in the Provider Dashboard.
- Notify Bumo of Unexpected Closures – If a Provider must close unexpectedly, they must notify Bumo immediately to prevent disruptions to families.
- Avoid Last-Minute Cancellations – Frequent cancellations or schedule inconsistencies may lead to temporary suspension or removal from the platform.
6.4 Compliance & Enforcement
Bumo maintains strict compliance policies to uphold the quality and reliability of child care services offered on the platform. If a Provider is found in violation of these Terms or fails to meet compliance standards, Bumo may take the following actions:
- Issue a Formal Warning – Providers will be given a written notice outlining the violation and the necessary corrective actions.
- Temporary Suspension – If violations persist, Bumo may temporarily suspend a Provider’s ability to accept new bookings.
- Permanent Removal from the Platform – In cases of repeated non-compliance or severe policy breaches (e.g., safety violations, misconduct, licensing fraud), Bumo reserves the right to terminate the Provider’s account.
Providers may appeal compliance actions by submitting a written request to providers@bumo.com within seven (7) days of receiving a violation notice. Bumo will review the appeal and respond within a reasonable timeframe.
7. Family Responsibilities
- Due Diligence: Families are solely responsible for researching and assessing a Provider’s qualifications, premises, and compliance with regulations.
- Child Information: Families must provide accurate and complete child information (e.g., allergies, immunization records) and communicate critical information directly to the Provider.
- Mobile App Usage: Families may use Bumo’s mobile apps to track bookings, communicate with Providers, and manage child profiles. Families are responsible for protecting their login credentials and for all actions taken under their account.
8. Custom Care Plan (CCP)
8.1 Overivew
Bumo may offer flexible medium- or longer-term care packages at discounted or special rates (“CCP”). Terms for each CCP (e.g., total hours, time slots, discount rates, and provider payout structures) are customized and presented to Families before finalizing.
8.2 Payment & Discounts
- Families can pay CCP fees up front or via an approved payment plan (e.g., third-party payment partner(s) such as Affirm), if available.
- Certain CCP packages may require deposits, partial payments, or have unique refund or cancellation rules.
8.3 Provider Payout
Providers may receive different payout rates for CCP sessions than for on-demand bookings. Bumo may pay Providers monthly, factoring in any pre-purchases, advances, or special agreements (e.g., guaranteed infant slots).
9. Payouts to Providers
9.1 Monthly Payouts
By default, Bumo issues monthly payouts to Providers (e.g., 18 days after the close of each month).
- Bumo calculates payouts based on completed and paid bookings, factoring in cancellations, partial refunds, or other adjustments.
- Providers must supply accurate ACH or bank information; Bumo is not responsible for any delays caused by incorrect or incomplete details.
9.2 Early Payout Option
- Providers may request early payouts before the standard monthly schedule, subject to an early payout fee.
- The fee may be calculated based on the time remaining until the normal payout date, total payout amount, or other parameters set by Bumo.
- By requesting an early payout, Providers agree to the published fees and any additional terms associated with that request.
9.3 Advances & Prepaid Slots
Bumo may offer “advance” payments or prepay for a set number of child care slots. Providers who receive such advances agree that Bumo will offset or deduct these amounts from future payouts.
9.4 Disputes & Adjustments
Providers have a limited window (e.g., 60 days from receiving payment) to dispute payout amounts. After that, payout records are considered final. Bumo may recover overpayments or settle disputes at its discretion.
10. Cancellations & Refunds
This section outlines our three-scenario framework for cancellations: Parent Cancels, Provider Cancels, and Bumo (Admin) Cancels. Specific policies may vary depending on the cancellation window (“Parent Window” vs. “Provider Window”) and any override or reason codes used by Bumo admins.
10.1 Parent Cancels
- Parent Window (e.g., 72 hours before session): If the parent cancels before this window, they typically receive a full refund, and the provider is paid $0.
- Between Parent Window & Provider Window (e.g., 48–72 hours): The parent receives no refund, the provider is paid $0, and Bumo may retain the entire booking fee.
- Under Provider Window (e.g., within 48 hours): The parent receives no refund, the provider is paid their full standard payout, and Bumo retains its normal commission.
(Extended or Premium tiers may have different hour thresholds. Exact times are displayed at booking.)
10.2 Provider Cancels
If a provider cancels, the parent always receives a full refund, and the provider receives no payout. Bumo collects no commission unless separately agreed upon (e.g., penalty fees). Bumo reserves the right to suspend or terminate Providers who frequently cancel bookings.
10.3 Bumo (Admin) Cancels
If Bumo’s support team processes a cancellation on behalf of either the parent or provider, Bumo will default to that party’s standard policy, unless an admin reason code applies to override or waive fees.
- Reason Codes (examples):
- Provider-Honored Cancellation
- Refundable Cancellation (doctor’s note)
- Force Majeure or Exceptional Circumstances
- Courtesy or Waived Cancellation
- Overrides: An admin may grant partial refunds, full refunds, or no refunds, depending on the reason code and circumstances.
10.4 Partial Refunds
Partial refunds are exceptions, typically granted via admin override or “special circumstances” reason code. In these scenarios:
- Bumo staff may refund a portion of the booking fee to the parent.
- The remainder is split as provider payout minus Bumo’s commission, unless Bumo also waives or adjusts that commission.
- All partial-refund overrides are logged with the reason code and authorized by Bumo staff.
10.5 No Monetary Refunds (BumoCredit)
Bumo’s default policy for parent-initiated cancellations (if done before the official cancellation window) is often to issue BumoCredit rather than a direct payment refund, unless otherwise specified in the location’s own policy. BumoCredit can be applied to future bookings. Please see Section 12 (BumoCredit) for details.
11. Custom Policies & Exempt Locations
Some Providers, particularly exempt (non-government monitored) locations, may have custom or stricter cancellation rules. Where explicitly stated on the Provider’s detail page, those policies override Bumo’s defaults. Families must carefully review each Provider’s unique policy and note whether the Provider is licensed or exempt.
12. BumoCredit & Gift Cards
12.1 BumoCredit
BumoCredit is store credit that Families can purchase or receive (e.g., from a cancellation). It is:
- Non-refundable and cannot be exchanged for cash (unless required by law).
- Usable at participating Bumo network locations, subject to expiration or usage limits set by Bumo or an enterprise client.
- Loaded via credit/debit card. Auto-reload features and promotional programs may apply.
- Tracked in your Bumo account. You are responsible for monitoring your balance and reporting any errors within 60 days.
12.2 Bumo Gift Cards
Bumo also sells digital gift cards. The same general rules for usage, redemption, and non-transferability apply. See the Bumo Platform or purchase page for additional details.
12.3 Bumo Gift Vouchers
Bumo may from time to time issue Gift Vouchers—digital or physical certificates that carry a fixed, pre-loaded monetary value (“Voucher Value”) redeemable toward eligible bookings on the Bumo Platform. Gift Vouchers are distinct from Gift Cards and are subject to the rules below:
- Expiration
- Unless a longer period is required by law, Gift Vouchers generally expire 30 days after the date you claim or activate them. Bumo may set a different expiration period for a specific voucher or promotion; the applicable date (or period) will always be shown in the email, SMS, or page where the voucher is delivered.
- Any unused Voucher Value remaining after the expiration date is forfeited and will not be refunded or credited.
- Redemption & Scope
- A Gift Voucher may be applied one time only to a new booking; any residual balance after a single redemption is forfeited.
- Gift Vouchers are not reloadable, cannot be combined with other Vouchers in a single transaction, and may not be used to purchase BumoCredit, Gift Cards, or additional Gift Vouchers.
- No Cash Value; Non-Refundable
Gift Vouchers are not redeemable for cash, except where required by law. They are non-refundable and may not be returned or exchanged for BumoCredit.
- Transfer & Loss/Theft
- Gift Vouchers are treated like cash—risk of loss and title pass to the purchaser or designated recipient upon electronic or physical delivery.
- Bumo is not responsible for damaged, lost, or stolen Gift Vouchers, or for unauthorized use. Replacement is at Bumo’s sole discretion and may require proof of purchase.
- Promotions & Discounts
Gift Vouchers issued as part of a promotion may contain additional restrictions (e.g., minimum booking value, day-of-week limitations). Any such restrictions will be disclosed at issuance and are incorporated by reference into these Terms.
- Compliance with Law
- Where local law prohibits expiration, dormancy fees, or other limitations on gift certificates, Bumo will comply with those requirements; otherwise, the terms above govern.
- The purchase, use, and redemption of Gift Vouchers are governed by these Terms of Use and by the law of the State of California (without regard to conflict-of-law principles).
13. Provider App & Dashboard
13.1 MVP Provider Dashboard
Bumo provides an online dashboard (web or mobile) for Providers to:
- View bookings (on-demand and CCP)
- Track earnings & payouts
- Update schedules and availability
- Access data-driven insights and manage center or home care settings
13.2 Onboarding
Providers undergo an onboarding flow to supply information about their facility, staff, rates, daily schedule, and to upload business and licensing documents. Providers represent and warrant that:
- All information submitted is accurate.
- Uploading photos, documents, or licensing details does not infringe any third-party rights.
- They comply with local laws regarding the handling of children’s data or images.
14. User Conduct & Community Guidelines
14.1 Prohibited Activities
Users (Families or Providers) must not:
- Violate any applicable law or regulation.
- Post false, misleading, or fraudulent information.
- Engage in harassment, hate speech, or threatening behavior.
- Impersonate another person or create multiple accounts for deceptive purposes.
- Attempt to scrape, copy, or distribute Bumo’s content or platform data without permission.
14.2 Reviews & Feedback
Users may post reviews of Providers or experiences. All reviews must comply with Bumo’s Community Guidelines, maintain respectful tone, and refrain from disclosing sensitive personal information of children or staff.
15. Child Privacy
Bumo takes children’s privacy seriously. Certain features require collecting personal information from or about children under 13 (e.g., name, age, allergy details) to facilitate safe child care bookings. By submitting any child’s information, you represent:
- Parental/Guardian Consent: You are the child’s parent or guardian (or have lawful authority) and consent to the collection and use of the child’s data.
- Limited Use: Bumo uses this information strictly to fulfill booking requests, generate licensing forms (if consented), and improve safety.
- Optional Photos/Videos: Providers may capture photos or videos of children under their care. Bumo strongly discourages sharing such material publicly without explicit parent/guardian permission. Bumo is not responsible for a Provider’s independent decisions to photograph or record children.
- Access/Deletion: Parents may review or request deletion of a child’s data by contacting support@bumo.com.
16. Intellectual Property
All content on the Bumo Platform—including software code, text, images, logos, and trademarks—belongs to Bumo or its licensors (“Bumo IP”). You agree not to reproduce, distribute, publicly display, or otherwise exploit any Bumo IP for commercial or competitive purposes without our express written permission.
17. Indemnification
You agree to indemnify and hold harmless Bumo, its affiliates, employees, officers, directors, agents, successors, and licensors from any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:
- Your breach of these Terms;
- Your negligence or misconduct;
- Any claim by a third party (including parents or providers) arising from your use of the Bumo Platform or the services provided (or not provided) through it.
Bumo reserves the right to assume its own defense in any matter subject to indemnification, and you agree to cooperate fully.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BUMO (INCLUDING ITS AFFILIATES, EMPLOYEES, OFFICERS, DIRECTORS, OR LICENSORS) DISCLAIMS ALL LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO:
- The use or inability to use the Bumo Platform;
- The actions or omissions of any Provider, including the quality, safety, or legality of their services;
- Errors or inaccuracies in licensing or child information;
- Cancellations or missed services;
- Any personal injury, property damage, or other harm that occurs during or after a booked session.
In no event shall Bumo’s total liability to you exceed the amounts actually paid by you, if any, to Bumo for the specific booking or service in question.
19. Dispute Resolution
19.1 Governing Law
These Terms and any dispute hereunder shall be governed by the laws of the State of California, without regard to conflict of law principles.
19.2 Arbitration & Waiver of Jury Trial
Any dispute arising out of or relating to these Terms shall be settled by final and binding arbitration administered by JAMS under its Comprehensive Arbitration Rules. The arbitration shall take place in Los Angeles County, California. BUMO AND YOU EACH WAIVE THE RIGHT TO A TRIAL BY JURY. The prevailing party in arbitration shall be entitled to reasonable attorney’s fees under California Civil Code §1717 (and related statutes).
20. Termination
Bumo may terminate or suspend your account, or remove any content you have posted, at any time for any or no reason, including a violation of these Terms. Upon termination, you are no longer authorized to access or use the Bumo Platform, and Bumo is not obligated to provide copies of any of your data or content.
21. Modifications to These Terms
Bumo reserves the right to revise or update these Terms at any time. We will notify you of material changes (e.g., via email or by posting a notice on the Bumo Platform). Your continued use of the Platform after such changes constitutes your acceptance of the modified Terms. If you do not agree, you should discontinue use of the Platform immediately.
22. Additional Legal Provisions
- Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Bumo regarding the Bumo Platform.
- Severability: If any provision is deemed invalid or unenforceable, the remaining provisions remain in full force and effect.
- No Waiver: Bumo’s failure to enforce a provision shall not be a waiver of its right to do so later.
- Assignment: You may not assign or transfer these Terms without Bumo’s prior written consent. Bumo may freely assign these Terms.
